1. Introduction These Terms and Conditions (“Terms”) govern your access to and use of our property listing, sales, rental, management, and associated real estate advisory services in Kenya (collectively referred to as the “Services”). By accessing, using, registering, or engaging with our Services, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our Services.

2. Definitions

• “Nurosa Properties”: Refers to the registered real estate entity providing property services.

• “User”: Any individual or entity who accesses, browses, or uses our platform.

• “Property Owner”: A person or legal entity with legal title or authorized rights to list a property.

• “Buyer” / “Renter”: Individuals or organizations interested in purchasing or renting a listed property.

• “Agent”: A licensed real estate professional engaged to list, manage, or broker deals on behalf of clients.

• “Platform”: The Nurosa Properties website, web application, mobile application, and any digital interfaces operated for the provision of Services.

• “Listing”: A property or land posted on the Platform for sale, rent, or lease.

• “SQ”: Servants’ Quarters, a common abbreviation in property descriptions in Kenya.

3. Eligibility

• Users must be 18 years or older and have legal capacity to enter binding contracts.

• Users must provide verifiable identification and proof of ownership or representation when listing properties.

4. Property Listings

• All properties listed must be lawful, accurately described, and accompanied by clear and updated photographs, dimensions, and location details.

• Nurosa Properties reserves the right to request supporting documents such as title deeds, approvals, and architectural plans before publishing listings.

• Misrepresentation or fraudulent listings will result in immediate removal and possible legal action.

• Properties listed as “Under Development” must indicate expected completion dates, payment plans, and developer details.

5. User Responsibilities

• Users are responsible for ensuring all information provided is truthful, updated, and compliant with local laws.

• Users must not upload content that is defamatory, illegal, obscene, or infringes intellectual property rights.

• Users agree to use the Platform solely for legitimate real estate purposes.

• Users must safeguard login credentials and notify Nurosa Properties immediately of any unauthorized access.

6. Viewing Arrangements and Site Visits

• All property viewings must be arranged in advance through authorized personnel or contact details provided.

• Nurosa Properties disclaims liability for any accidents, damages, or injuries occurring during physical site visits.

• Viewings are subject to availability and consent of the Property Owner or authorized representative.

7. Transactions & Agreements

• All negotiations, offers, or acceptance of property sales, leases, or rentals must be executed through formal written agreements in compliance with Kenyan law.

• Nurosa Properties may facilitate introductions or offer advisory services but is not liable for any contractual disputes between parties.

• Buyers and renters are strongly advised to conduct independent due diligence, property valuation, and legal verification before making payments.

8. Fees, Commissions, and Payments

• Listing may be free or subject to charges depending on the package selected.

• Nurosa Properties shall be entitled to commissions for successfully closed sales or leases as outlined in the service agreement.

• Service fees for additional offerings such as virtual tours, featured listings, or property management will be quoted in advance.

• All payments are to be made in Kenyan Shillings via authorized payment channels including M-PESA, bank transfer, or mobile banking.

• Commissions are payable upon completion of sale/lease and are non-refundable.

9. Refund & Cancellation Policy

• Cancellations must be made in writing within 24 hours of listing to be eligible for a refund.

• Refunds will not be issued for properties delisted due to breaches of these Terms or fraudulent conduct.

10. Privacy and Data Protection

• Nurosa Properties processes personal data in compliance with the Kenya Data Protection Act, 2019.

• Information collected may include names, contact details, property documents, and transaction records.

• By using our Platform, you consent to the collection, storage, and use of your personal data for service delivery, legal compliance, and marketing.

• Users have the right to request data correction, deletion, or access as per applicable law.

11. Intellectual Property Rights

• All content on the Platform including text, images, design, code, and logos are the intellectual property of Nurosa Properties.

• Unauthorized use, reproduction, or modification is strictly prohibited and may result in legal action.

12. Limitation of Liability

• Nurosa Properties provides listings and Services on an “as-is” and “as-available” basis.

• We do not warrant that the Platform will be error-free or that listings will be completed successfully.

• Nurosa Properties shall not be liable for any losses, damages, or missed opportunities resulting from the use of the Platform.

• Users agree to indemnify and hold harmless Nurosa Properties and its agents from claims or damages arising from misuse of the Service.

13. Termination and Suspension

• Nurosa Properties reserves the right to suspend or terminate user access for violations of these Terms, misuse, or illegal conduct.

• In such cases, listings may be removed, and outstanding commissions may be forfeited.

14. Modifications and Updates

• These Terms may be updated periodically. Users will be notified of changes via email or notices on the Platform.

• Continued use of the Platform after updates constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the Republic of Kenya.

• Disputes shall be referred to arbitration or the competent courts in Nairobi, unless otherwise agreed.

16. Miscellaneous

• If any part of these Terms is held unenforceable, the rest shall remain in full force and effect.

• Failure to enforce any part of these Terms does not constitute a waiver.
